IRS Issues Final Rules for Crypto Broker Reporting

The U.S. Internal Revenue Service (IRS) has released the final version of its new crypto broker reporting requirements, clarifying which industry participants will be affected by the new regulations.

According to the IRS’s updated guidelines, decentralized exchanges and self-custody wallets are not included under the new reporting rules. The IRS acknowledged the widespread comments and concerns from the industry, stating it needed more time to fully understand the complexities of decentralized networks.

However, stablecoins and tokenized real-world assets are not exempt from the new reporting requirements and will be treated the same as other digital assets.

IRS Commissioner Danny Werfel emphasized the importance of closing the tax gap posed by digital assets and addressing potential noncompliance among high-net-worth individuals:

“We need to ensure digital assets are not used to conceal taxable income. These final regulations will help detect noncompliance in the high-risk area of digital assets. Our research and experience show that third-party reporting improves compliance.”

This sentiment was echoed by Guy Ficco, head of the IRS criminal investigation division, who anticipates an increase in crypto tax evasion during the 2024 tax season.

Summary Review: The IRS’s new rules aim to enhance tax compliance in the rapidly evolving digital asset space by requiring more comprehensive reporting, while also considering the unique challenges posed by decentralized technologies.
